By enrolling my child in the Children’s Program, I acknowledge and agree that:
- When supervision begins and ends
My child will be supervised by the Children’s Program only:
- during the published program hours;
- while my child is within the designated Children’s Program area; and
- after my child has been checked in or personally handed over to an authorised program staff member.
Program supervision ends when my child is collected or checked out by me or another person I have authorised.
- Areas and times that are not supervised
I understand that the Children’s Program does not supervise children outside the designated program area or outside the published program hours.
Unless Spiritgrow expressly states otherwise, supervision is not provided in hotel bedrooms, corridors, foyers, lifts, stairways, toilets, dining areas, recreational facilities, car parks or other areas of the hotel.
I remain responsible for supervising my child in these places and at all times before check-in and after collection or check-out.
- Delivery and collection
I am responsible for bringing my child directly to the Children’s Program and ensuring that an authorised staff member has accepted my child into the program.
I am also responsible for collecting my child promptly when the program finishes or when requested by program staff. I will not assume that my child is being supervised merely because my child is somewhere within the hotel.
I will remain contactable throughout the program and, unless otherwise agreed with Spiritgrow, will remain at the hotel and be available to attend to or collect my child promptly.
- Conduct
I will ensure that my child understands that they must:
- remain within the designated program area;
- follow reasonable safety and behavioural directions;
- treat the hotel, its property, program equipment, staff and other participants respectfully; and
- not enter any area that program staff or the hotel has identified as restricted or unsupervised.
Spiritgrow may require me to collect my child where the child’s behaviour creates a material risk to themselves, another person or property, or prevents the program from operating safely.
- Damage caused by my child
I accept responsibility for reasonable, documented costs arising from loss or damage to the hotel, the program venue, program equipment or another person’s property where that loss or damage was caused by my child’s deliberate, reckless or negligent conduct or failure to follow reasonable directions.
This responsibility does not extend to ordinary wear and tear, an unavoidable accident for which my child was not at fault, or loss or damage caused or contributed to by the negligence or unlawful conduct of Spiritgrow, the hotel or another person.
- Injury or loss outside the program’s care
To the maximum extent permitted by law, Spiritgrow and its staff and volunteers are not responsible for injury, loss or damage occurring:
- before my child has been accepted into the program;
- after my child has been collected or checked out;
- outside the published program hours;
- outside the designated program area when Spiritgrow has made clear that supervision is not being provided; or
- while my child is under the supervision or responsibility of a parent, guardian or another person.
The hotel provides the venue but does not operate the Children’s Program or assume responsibility for supervising participating children.
- Health and emergency information
I will provide accurate and complete information about my child’s allergies, medical conditions, additional needs, medications and emergency contacts.
If my child becomes ill, is injured or cannot participate safely, I agree to collect them promptly when contacted. If reasonably necessary, I authorise program staff to provide first aid and arrange emergency medical or ambulance assistance. I am responsible for medical or ambulance expenses not otherwise covered, except to the extent that the expense results from another person’s legal responsibility.
- Rights that cannot be excluded
Nothing in these terms excludes, restricts or modifies any right, guarantee, duty or liability that cannot lawfully be excluded, restricted or modified, including obligations relating to child safety and liability arising from negligence where the law does not permit that liability to be excluded.
These terms are governed by the laws of Victoria, Australia.
Parent or Guardian Agreement:
I confirm that I am the child’s parent or legal guardian, or that I have authority to enrol the child. I have read and agree to the Children’s Program — Supervision and Parent Responsibility terms, including the clearly defined limits of program supervision and my responsibility for my child outside those limits.
